William Messenger of the Virginia-based National Right to Work Legal Defense Foundation, representing a second group of providers opposed to unionizing, called the measure a case of “collectivizing providers†and added: “Citizens cannot be collectivized to make them happy.†He argued that it should be invalidated because it violates the providers’ constitutional right of free association.  (Note from Bill Messenger:  Just so everyone knows, my statement that “Citizens cannot be collectivized to make them happy†was not a statement to the press. It was something that I said during oral argument in court in response to an AFSCME argument that providers can be unionized because it will increase their morale. )

Indeed, it is precisely this politicization of what is supposed to be an independent agency with quasi-judicial powers that has led to the partisan politicization of the confirmation process in the Senate.  In terms of NLRB appointments, it is now standard practice for Democratic presidents to nominate top lawyers for labor unions and for Republican presidents to nominate officials from the virulently anti-union National Right to Work Committee or the U.S. Chamber of Commerce. In other cases, they name Senate staffers from their respective parties who have proven track records of protecting union or employer interests.
